Preamble


The company “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” with headquarters at 5 rue des Turbigo 75001 – Paris, engages in the organisation of third party sales of products and/ or services to its customers.
The Customer may make requests by phone or email for the purchase of services that will be provided through “PerlaNera – Tourism Consulting & Services -PNTCS Sarl”
The “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” company therefore intervenes merely as an intermediary in relations between the Customer
and the providers of products and/ or services (vendors), being in some cases direct supplier if the requested service does not require a specific qualification.

Article 1: Application of general conditions of sale


These General Conditions of Sale available on the site http://www.perlaneraconcierge.com are routinely sent to each Customer to enable him/her to make orders. Consequently, any order placed by the Customer entails compliance, without limitation or qualification, with these General Conditions of Sale which shall prevail over any other documents issued by “PerlaNera – Tourism Consulting & Services -PNTCS Sarl”.
Any other condition proffered by the Customer, in the absence of prior and express agreement by “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” will not be binding on the company, regardless of when it was brought to the attention of the latter. If on occasion “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” does not exercise its rights under any of the  provisions of these General Conditions of Sale, this forbearance shall not be interpreted as a waiver of its right to exercise its rights later under any of said conditions. The Customer confirms that it has read and agrees to the General Conditions of Sale below before making any order for products and/ or services.

Article 2: Prices


Products and services will be billed based on prices specifically listed, in Euros and with all taxes included, on confirmation of the order by “PerlaNera –  Tourism Consulting & Services -PNTCS Sarl”.

Article 3: Orders


To make orders and inquires about products or services offered by “PerlaNera -Tourism Consulting & Services -PNTCS Sarl” the Customer can use the following means:

– by contact form on http://www.perlaneraconcierge.com

Before any order, the Customer must provide “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” with his/her private or work address, email address and telephone number to enable “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” to contact him/her as soon as possible. The Customer recognises to be of age and have the legal capacity to commit to paying.
Orders for products  and/ or services made by the Customer, by telephone, email or through http://www.perlaneraconcierge.com will be sent to the providers via “PerlaNera -Tourism Consulting & Services -PNTCS Sarl”.
All orders will be confirmed to the Customer by “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” by email. This confirmation will include:
– the order number;
– the nature of the product and/ or service ordered;
– the quantity of the product and/ or service ordered;
– the unit price of the product and/ or service ordered, net of taxes and with all taxes included;
– the delivery date/time of the product and/ or service ordered;
– the delivery arrangements for the product and/ or service ordered;
– cancellation conditions.
These orders shall not be finalised until receipt by “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” of the written acceptance/ signed quotation and full payment by the Customer.

“PerlaNera – Tourism Consulting & Services -PNTCS Sarl” will send the Customer, if necessary, all the relevant information for the order, including:
– reservation numbers (restaurant booking, tickets, ect.),
– departure and arrival  dates, times and places (transportation services)
– names and addresses of suppliers of products and/or service providers.

All orders are subject to service availability from the supplier(s) and service provider(s).
The company “PerlaNera – Tourism Consulting & Services -PTCS Sarl”, as the intermediary, is not responsible for the unavailability of the product or service. The Customer will be contacted and alternative solutions will be suggested as soon as possible if:
– the products and services ordered are not available;
– the nature of the product or service ordered has been changed;
– the price of the product or service ordered by the Customer has changed;
– the price of the product or service indicated by “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” to the Customer has changed.

The suggested alternatives will be implemented upon receipt of a written agreement returned by the Customer. If no alternative can be found or accepted by the Customer within 5 working days, the “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” will proceed to outright cancellation of the order.  No compensation of any nature whatsoever shall be charged to “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” by the Customer because of this circumstance. In the event that a payment has been made, and unless the alternative solution found is totally different from the Customer’s order, the latter shall be directly reimbursed by “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” in case of cancellation of the order.

Article 4: Payment terms


Products and services will be charged on the basis of precisely specified rates in euros and including all taxes.

Following the reception by “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” of the quotation signed by the Customer, the payment will be required and the Customer’s card will be charged. All credit/debit card details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties.
As a courtesy, “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” will email a receipt to the Customer’s email address upon reception of the payment.
In case of no reception of the payment from the Customer, the company “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” will cancel the purchase in progress.

VOUCHER

The Customer’s order shall be definitively confirmed upon receipt of the voucher that shall be sent to him in order to confirm the approval of the order to the email address provided by the Customer. The Customer is required to read the email to access their voucher and is solely responsible for its printing. The Customer must print the voucher and present the original voucher to the service provider, so that the reservation can be honored.

Article 5: Change of order


Any amendment  of an order made by the Customer (except for products and/or services referred as “non-editable” or “non-refundable”) must be made within a maximum of 7 working days to be taken into account by “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” who will evaluate in accordance with the type of products or services if the amendement can be made. Any change of an order by the Customer is subject to express acceptance of “PerlaNera-Tourism Consulting & Services -PNTCS Sarl”.
Under these conditions, no charges will be applied. After 7 working days, “Perlanera-Tourism Consulting & Services – PNTCS Sarl” will apply a fee of editing 10€ (ten euros) (except for the “non-editable” or “non-refundable”products/services)
If “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” refuses to amend the order requested by the Customer, the price of the order will still be payable by the Customer; any amounts already paid by the Customer will not be returned under any circumstances.

Any modification request must be sent to info@perlaneraconcierge.com (specifying the reservation number, the name of the referring Customer and the date), which will process this request as soon as possible
For the indicated services “not cancellable, not modifiable” or on certain special dates, any modification is impossible.

Article 6: Cancellation of reservation


Any request for cancellation must be sent to info@perlaneraconcierge.com specifying the reservation number, the Customer’s name and the service date. We shall process your request as soon as possible. The following cancellation fees will apply to all products and services:

  • more than 30 calendar days prior to service: no cancellation fee
  • between 30 and 15 calendar days prior to service: 25% of product /service price
  • between 14 and 8 calendar days prior to service: 50% of product /service price
  • between 7 calendar days and 0 day prior to service: 100% of product /service price

Any interruption of service during the performance, by the will of the customer can not give rise to any refund. Any Customer arriving late will be considered “no show” and will not be refunded, regardless of the reason for the delay.

“PerlaNera – Tourism Consulting & Services -PNTCS Sarl” reserves the right to cancel or modify certain products and/or services without notice if the Customer’s comfort or safety are at risk, or  in case of force majeure, strike, demonstration, administrative decision or exceptional closure.

Article 7: Liability


The Customer expressly agrees that “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” as a mere intermediary, is merely under an obligation of means. “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” therefore cannot incur, whatever the reason, any compensation of any nature whatsoever, the supplier alone being liable.

The Customer shall therefore directly contact “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” concerning any claims for damages or any other questions regarding the product or service.
“PerlaNera – Tourism Consulting & Services -PNTCS Sarl” is exempt from any liability for the execution of the contract for sale and delivery of the products and services ordered.
“PerlaNera – Tourism Consulting & Services -PNTCS Sarl” may forward to the provider letters of complaint sent by the Customer.

In any event, “PerlaNera – Tourism Consulting & Services -PNTCS Sarl” shall not be held liable for breach of its obligations in case of force majeure as defined by the Civil Code, especially in the case of total or partial strike, flood, fire, computer failure, etc..  (non-exhaustive list).

Article 8: Protection of personal data (CNIL)

Under the Law on Information Technology and Freedoms of 6 January 1978, the Customer has a right of access, correction and objection to the personal data that concerns him/her.
To do this, the Customer must simply submit a request to “PerlaNera – Tourism Consulting & Services -PNTCS Sarl”, online or by mail, stating his/her name and address.

Article 9: Confidentiality

The company “PerlaNera, Tourism Consulting & Services – PNTCS Sarl” undertakes not to disseminate the personal information of its Clients, provided that they are not already in the public domain.

Article 10: Intellectual Property Rights

All documents, information, texts, images, photographs reproduced on the website of the company “PerlaNera, Tourism Consulting & Services – PNTCS Sarl” or on paper and electronic documents are strictly reserved for the copyright of the property Intellectual property. Any reproduction, total or partial representation of all or part of the elements is strictly prohibited.

Article 11: Applicable law

The company “PerlaNera, Tourism Consulting & Services – PNTCS Sarl” is a French company. The law applicable to contractual relations is French law exclusively.
